By using the Services, you agree that you have read, understand, and are bound by these Terms, as amended from time to time, and that you will comply with the requirements listed herein. 1. SERVICES
(a) The Services include the provision of a platform that enables you to arrange and schedule various home-based services with independent third-party service providers of those services (“Service Professionals”). As part of the Services, Oxwon facilitates the transfer of payments to Service Professionals for the services provided to you and collects payments on behalf of such Service Professionals.
(b) Services provided by service professionals are referred to as “Pro Services”. The term “Services” does not include Pro Services. Oxwon Pro does not provide services and is not responsible for their provision. Service Professionals are solely liable and responsible for the Pro Services they provide or otherwise provide through the Platform. Oxwon and its affiliates do not employ service professionals, nor are service professionals agents, contractors, or partners of Oxwon or its affiliates. Service Professionals do not have the capacity to bind or represent Oxwon.
(c) the Platform is for your personal and non-commercial use only, unless otherwise agreed in accordance with the terms of a separate agreement. You agree that if you avail the Services or Pro Services from any legal jurisdiction other than the territory of India, you will be deemed to have accepted the Oxwon Terms and Conditions applicable to that jurisdiction.
(d) The Services are provided under various brands owned or otherwise licensed by Oxwon and its affiliates.
(e) A major part of the Services is OXWON's ability to send you text messages, electronic mail or WhatsApp messages, including in connection with your booking, your use of the Services, or as a part of its promotional and marketing strategies. Although you may opt out of receiving these text messages by contacting Oxwon at privacy@oxwon.com or through in-platform settings, you agree and acknowledge that this will affect Oxwon's use of the Services (or A portion) may be affected. 5. BOOKINGS
(a) Order: The Platform allows you to request various Pro Services at a time of your choosing depending on the available slots. If, in the unlikely event that we are unable to find a service professional for a specific time frame, we will contact you to find an alternative time.

Once your booking is confirmed, you will be required to make payment in accordance with these Terms or as specified on the Platform. (c) Cancellation: Bookings canceled before confirmation on the Platform will not be charged. Oxwon's cancellation policy sets forth the applicable cancellation fees.
(d) Substitution: In the event of non-availability or cancellation of the selected Service Professional, we will provide you with a substitute Service Professional from among our registered Service Professionals.
6. PRICING, FEES, AND PAYMENT TERMS
(a) Oxwon reserves the right to charge you from time to time for various services you avail of on or through the Platform and/or any other facilities you choose.
(b) Charges and Fees in respect of Pro Services:
(i) In respect of the Pro Services you wish to avail through the Platform, you shall pay the Service Professionals the amount stated at the time of booking as well as (a) any additional Pro Services you avail of; The amount to be paid shall include (b) out-of-pocket expenses incurred by the Service Professional, and (c) expenses arising from the purchase of goods required or used for the performance of the Service Professional (“Fees”). You acknowledge that the final bill you receive may include additional charges, including, without limitation, security fees, warranty fees, insurance fees or service professional wellness fees.
(ii) Oxwon will inform you of the applicable fees, charges and payment methods at the time of booking. Generally, you can pay for Pro Services through Credit Card, Debit Card, Net Banking, Wallet, UPI or cash on completion of Pro Service. We reserve the right to modify and otherwise restrict the payment methods available to you. You acknowledge that certain payment methods such as cash upon completion may not always be available to you as a payment method. For the avoidance of doubt, if you pay via the 'cash on completion' method, you acknowledge that you will be required to pay both the fees and charges to the Service Professional.
(iii) Fees and charges as specified by Oxwon may be payable at the time of booking or upon completion of the Pro Service.
(iv) For the avoidance of doubt, please note that the Fees are payable to Service Professionals, and Oxwon acts as a limited collection agent to collect and transfer the amounts due thereon on behalf of such Service Professionals.
(v) Taxes: All fees and charges are inclusive of applicable taxes.
(vi) Oxwon reserves the right to make appropriate amendments to the Fees and Charges at any time in its sole discretion. The change in charges will not affect any bookings confirmed prior to the publication of the revised charges on the Platform.
(vii) The fees and charges paid by you are final and non-refundable, unless otherwise determined by Oxwon or required by applicable laws. Under certain laws, you may be entitled to a refund or other remedies for failure to provide services.
(viii) You acknowledge and agree that applicable fees and charges may increase significantly in certain geographic areas during periods of high demand. Oxwon will use reasonable efforts to inform you of applicable fees and charges. However, by using the Pro Services or Services, you will be responsible for any charges and fees incurred under your account regardless of your awareness of such charges or fees.
(c) Payment Processor: We may use a third-party payment processor (“Payment Processor”) to bill you through your selected payment mode. The processing of payments will be subject to the terms and policies of such payment processor in addition to these Terms. We will not be liable for any errors by the payment processor. In case of any unsuccessful payment, the debited money will be credited as per the terms of the payment processor.
(d) Cancellation: You may choose to cancel your request for services from a Service Professional at any time prior to the arrival of such Service Professional, in which case you may be charged a cancellation fee as per Oxwon's cancellation policy. Oxwon reserves the right to charge you, or otherwise deduct applicable taxes, in connection with such cancellation fees.
(e) Subscriptions: Oxwon may from time to time offer subscription packages (however named) for monetary consideration. The package will provide additional benefits to customers, which may include the ability to take advantage of discounted Pro services. You agree that Subscription Packages (however named) will be subject to additional terms and conditions. (f) Oxwon does not designate any portion of your payment to the Service Professional as a tip or gratuity. 7. CUSTOMER CONDUCT

8. THIRD PARTY SERVICES

You understand and acknowledge that Third Party Services are the sole responsibility of the third party that created or provided them and that your use of such Third Party Services is at your sole risk.
(b) We make no representations and exclude all warranties and liabilities arising from or relating to such third party services, including their accuracy or completeness. If you avail any Third Party Services, you will be governed by and bound by the terms and conditions and privacy policies of the third parties providing the Third Party Services. Additionally, all intellectual property rights in and to the Third Party Services are the property of the respective third parties.
9. YOUR RESPONSIBILITIES

12. DISCLAIMERS AND WARRANTIES

We are not liable or responsible for the fulfillment of any Booking, for the performance of Pro Services by any Service Professional, or for any acts or omissions of Service Professionals during the provision of Pro Services, including any damage caused to the Property. (i) your use of, inability to use, or the availability or unavailability of the Services or Pro Services;
(ii) the occurrence or existence of any defects, interruptions or delays in the operation or transmission of information or information through the Services, including communications failure, theft, destruction, or unauthorized access to our records, programs, services. 16. MISCELLANEOUS PROVISIONS
